Provider & Practice Employee Consent to HIPAA Agreement
This Consent to HIPAA Agreement (“Agreement”) is entered into between Neem Health (“Platform”) and the participating healthcare provider (“Provider”) and their authorized employees, administrative staff, and any other personnel handling PHI (“Practice Employees”). By using Neem Health, the Provider and Practice Employees agree to comply with the following terms to ensure adherence to the Health Insurance Portability and Accountability Act (HIPAA) and to protect the privacy and security of Protected Health Information (PHI) handled through the platform.
Definitions
- Provider: A licensed healthcare professional, medical group, clinic, or healthcare entity that has registered for a Neem Health account by creating a username and password and has agreed to the terms of this Agreement.
- Practice Employee: Any individual authorized by the Provider to access Neem Health on their behalf, including both clinical (e.g., nurses, medical assistants) and non-clinical (e.g., administrative staff, care coordinators) personnel, who has registered for a Neem Health account by creating a username and password and has agreed to the terms of this Agreement.
- Protected Health Information (PHI): Any individually identifiable health information transmitted or maintained in any form, as defined under HIPAA
- Platform: Refers to Neem Health’s technology, software, services, and infrastructure used to support patient-provider interactions appointment bookings, and care coordination.
1. HIPAA Compliance Commitment
Providers and Practice Employees acknowledge that Neem Health is a HIPAA-compliant platform designed for secure communication and management of PHI between:
- Providers, Practice Employees, and patients for appointment scheduling, document sharing, and follow-ups.
- Providers, Practice Employees, and other providers for referrals, health record sharing, and care coordination.
2. Responsibilities of the Provider & Practice Employees
Providers and their Practice Employees agree to comply with the following practices when using Neem Health:

Providers and Practice Employees acknowledge their responsibility for ensuring HIPAA compliance while using Neem Health.
Neem Health is not liable for breaches resulting from:
- Provider’s or Practice Employee’s misuse of the platform.
- Inaccurate or incomplete PHI entered by the Provider or Practice Employee.
- Actions taken outside Neem Health’s secure platform.
Providers are responsible for the actions of their Practice Employees when handling PHI on Neem Health.
4. Acknowledgment and Acceptance
By signing this Agreement or using Neem Health, the Provider and Practice Employees:
- Acknowledges and consents to the terms outlined above.
- Accepts full responsibility for complying with HIPAA laws when using Neem Health.
- Agrees to Neem Health’s Terms and Conditions, which are incorporated by reference and accessible here.
5. Modifications
Neem Health reserves the right to update this Agreement. Providers and Practice Employees will be notified of significant changes, and continued use of the platform will indicate acceptance of such updates.
